Terms of use

These terms apply when you use winkhq.com (the “website”) or the Wink app at app.winkhq.com (the “app”). By using either, you agree to them. If your company has signed a proposal or agreement with us, that agreement sets your fees, term and service commitments, and it wins wherever it differs from these terms.

Who we are

Wink is the trading name of Wink Labs (Pty) Ltd (registration number 2026/740929/07), a private company registered in South Africa, at 252 Church Road, Walmer, Port Elizabeth, 6065, South Africa. Email hello@winkhq.com.

Using the website

You may use the website to learn about Wink, read our guides and comparisons, and book a demo. Do not misuse it, for example by trying to break its security, overload it, or copy its content in bulk or with automated tools.

Your app account

App accounts are for people your company has subscribed for. Keep your login details to yourself and tell us straight away if you think someone else has used your account. You are responsible for what happens under your login.

Your company’s account owner decides who has access and can remove users at any time.

Using the app

Use the app only for your company’s own business. Do not:

• share your login, or give access to anyone outside your company without our written agreement
• try to identify any survey respondent, or combine results with other data in order to do so
• resell the app or its results as a research product of your own
• reverse engineer the app, test its security without our permission, or interfere with how it runs
• use it to break the law or anyone’s rights

We may suspend access that breaks these rules. Where we can, we will tell you first and give you a chance to fix it.

Your results

The brand tracking results produced for your company are yours to use inside your business, including with your agencies and advisers. You may quote them publicly if you name Wink as the source and do not misrepresent them.

Survey results are estimates from a sample of real people. Every figure has a margin of error, and early reads rest on fewer responses. Treat them as evidence for decisions, not certainties.

Ask Wink

Ask Wink uses an AI model to answer questions about your results. Its answers can be incomplete or wrong. Check anything important against the underlying figures in the app before you act on it.

Our content and the app

The website, the app, our software, methods, charts and text belong to Wink Labs or our licensors. Your subscription gives you the right to use the app while it is active. It does not transfer ownership of any of it.

You may share links to the website and short quotes from it, with attribution.

Oat Co and the other brands in our examples are made up. Their data is sample data, not real research.

Comparisons and other companies

Comparison pages are based on each company’s public information on the review date shown on the page and may be out of date. Other company names and trademarks belong to their owners. Wink is not affiliated with or endorsed by them. If you spot something out of date, email hello@winkhq.com and we will correct it.

Prices

Prices on the website are a guide. Your price is confirmed in a written proposal and may change before you sign.

Availability

We work to keep the website and app available and accurate, and we sometimes take them offline for maintenance. Unless your agreement with us says otherwise, we provide them as they are, without promising they will always be available or free of errors.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data, arising from your use of the website or app. Nothing in these terms limits liability that cannot be limited under South African law. If your company has an agreement with us, the liability terms in that agreement apply.

Privacy

Our privacy policy explains how we handle personal information.

Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change materially affects app users, we will tell them by email before it takes effect.

Governing law

These terms are governed by the laws of South Africa, and the courts of South Africa have jurisdiction.
